TERMS AND CONDITIONS

In consideration of being allowed to participate in any way in the organization’s related events and activities, the Participant (or the participant’s parent/guardian, if applicable) acknowledges and agrees to all terms and conditions. 

Every Participant that participate in the program / events means that the Participant (or the participant’s parent/guardian, if applicable) had read and agrees to all terms and conditions.

1) The participant is voluntarily participating in the activities, competitions, programs, and service of the organization at the facilities which activities take place and freely accept and fully assume all responsibility for all Risks and possibilities of injury, personal injury, damages, death, property damage, expense, loss of income or loss of any kind suffered by the participant during or resulting from participation in the activities involved in this program.  The Participant agree to accept these risks and agree to the terms of this waiver EVEN IF the organization or volunteers / personnel is found to be negligent or in breach of any duty or care or any obligation to me in my participation in the Activities involved.

2) COVID-19 is a worldwide pandemic declared by the World Health Organization and COVID-19 is extremely contagious. The organization has put in place preventative measures to reduce the spread of COVID-19. However, the organization cannot guarantee that the participant will not become infected with COVID-19. Further, participating in the activities could increase the participant’s risk of contracting COVID-19 or any other contagious disease that may result in personal injury, illness, permanent disability, or death and that the participant (Or the participant’s parent/guardian, if applicable) is responsible for choosing their own safety or protective equipment and the secure fitting of that equipment.

3) The risk of injury from the activities involved in this program is significant and have foreseeable and unforeseeable inherent risks, hazards, and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis, and loss of life. While rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and that activity includes but is not limited to sports, fitness, functions, instruction, use of the facilities, participation in programs, tournaments and services provided by facility and organization.   
4) The participant willingly agrees to comply with the stated and customary terms and conditions for participation:
a) If the participant observes any unusual significant hazard or risk during participation, the participant will remove themselves from
participation and immediately makes their observation to representative of the organization; 
b) Comply with the rules of the participation in activities;
c) Respect the rules of the installation or equipment;
d) When the participant trains or practices in his/her own space, the participant (or the participant’s parent/guardian, if applicable) is
responsible for the participant’s environment and the location and equipment that is selected for the participant;
e) The participant’s mental and physical state is appropriate to participate in the activities and that the participant (or the participant’s
parent/guardian, if applicable) assumes all risks related to the participant’s mental and physical state;
d) It is the sole responsibility of the participant (or the participant’s parent/guardian, if applicable) to assess whether certain activities are
too difficult for the participant. By starting an activity, the participant (or the participant’s parent/guardian, if applicable) acknowledges
and agrees to the relevance and conditions of the activity;.
f) The participant (Or the participant’s parent/guardian, if applicable) is responsible for choosing their own safety or protective equipment
and the secure fitting of that equipment;
g) The participant shall not participate if he or she is weakened in anyway;
h) The COVID-19 is contagious in nature and that the participant may be exposed to or infected with COVID-19 and that such exposure may
results in injury, illness, permanent disability or death;
h) The participant must do a COVID-19 self assessment at home before attending the activities, if the participant experiencing any of the
COVID-19 symptoms or think he or she may have COVID-19. The participant must stay home and not attend the activity;
i) The Participants shall not use any of the facilities that are out of designated gym areas. Loss or damage to any of all facilities / equipment,
damage or injury to any other members, caused by misconduct of the participant or their family members / guest, shall be liable by the
participant (and the participant’s parent/guardian, if applicable);
j) The participant shall comply with the rules and regulations of the facility where the activities are held.

5) In addition to consideration given to the organization for my participation in Activities, the participant, and their heirs, next of kin, executors, administrators, and assigns (collectively their “Legal Representatives”), agree:

To waive all claims that have or may have in the future against the organization (this reference includes its officers, directors, coaches, officials, volunteers, and employees)
To release and forever discharge the organization from all liability for all personal injury, death, property damage or loss resulting from participation in activities due to any cause, including but not limited to negligence (failure to use such care as a reasonably prudent and careful person would use under similar circumstances), breach of any duty imposed by law, breach of contract or mistake or error of judgement of the organization to be liable for and to hold harmless and indemnify the organization from all actions, proceedings, claims, damages, costs, demands including court costs and costs on a solicitor and client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with my participation in Activities. 
6) If any part of this agreement shall be held invalid, that part shall be deemed excluded from this agreement and the remainder of the agreement shall remain in full force and effect.

7) The participant (or the participant’s parent/guardian, if applicable) understand that members, volunteers, and staff may take PHOTOS of those participating in the programs, activities, and events and that the organization have full rights to the use of the photos of the participant (and the participant’s parent/guardian, if applicable) to print and/or on-line materials for promotion of the organization’s activities without any compensation.
(Participant may opt-out with a written notification notice of not having photos taken.) 

8) The organization reserve the rights to remove the participant from the activities if the participant violates the agreement or their behavior deemed inappropriate such as causing nuisance or disturbance or not respecting other participants / volunteers / coaches which cause the disruption of the class and enjoyment of other participants. And the organization has no liability or responsibility to refund the fees he or she has paid.

9) If the participant is in default of payment of any fees for programs that require a fee or the participant provided false information on the registration, the organization reserve the rights to remove the participant from the program and / or activity.

10) If the participant missed 3 classes without notice, it is assumed that the participant has dropped out of the program / class and the spot will be given to another participant. Also, there will be NO refund for the program as Membership fees are non-refundable, non-transferable to another class or person and cannot be pro-rated)

11) The participant (or the participant’s parent/guardian, if applicable) agrees to receive communication from the organization by telephone, email, text, or social media.

12) The participant (and the participant’s parent/guardian, if applicable) state that he or she is physically able to proceed with badminton activities and have disclosed all relevant medical and physical barriers that may have had prior to participating in the activities.  

13) The participant (and the participant’s parent/guardian, if applicable) agree that the organization has the discretion to modify the structure of any activities due to a public health or safety issue or for any other reason, which may include removing specific discipline or age groups from the activities, changing the program or activities in a way that which individuals can continue to participate.

14) The participant (and the participant’s parent/guardian, if applicable) agree that the organization has the discretion to remove any participant (and the participant’s parent/guardian, if applicable) who does not comply with the public health or safety issue or wear personal protective equipment when required, the participant is responsible for providing his or her own personal protective equipment. And the organization has no liability or responsibility to refund the fees he or she has paid.

15) The participant (and the participant’s pare/guardian, if applicable) agree that the organization has the discretion to cancel any schedule activities or program at anytime.  The organization has no liability or responsibility to the participant (and the participant’s parent/guardian, if applicable) (including reimbursement/refunding registration fees or membership fees) if an activity or program is cancelled or postponed by the Organization or for any other reason, including a public health or safety concern.

16) The Organization is not responsible or liable for any damage to the Participant’s (and the participant’s parent/guardian, if applicable) vehicle, property, or equipment that may occur because of the activities.

17) The participant (and the participant’s parent/guardian, if applicable) fully understands that each activity or programs has its own membership fee, and the fees are non-refundable and non-transferable to another person or activities or programs.

18)The participant (and the participant’s parent/guardian, if applicable) assumes all risks arising from his or her participation in the activities or programs associated with or related to them and waives any claim that he or she may have, now or in the future, against the organization. The participant (and the participant’s parent/guardian, if applicable), fully accepts and assumes all risks and possibility of injury, death, property damage, expenses, and related losses, including loss of income, resulting from participation in the activities.
